MAG releases S.B. 359 COVID-19 liability fact sheet

The Medical Association of Georgia has developed a fact sheet that addresses the ‘Georgia COVID-19 Pandemic Business Safety Act’ (S.B. 359), which would provide certain liability protections for health care facilities, physicians and allied health care professionals, and businesses until July 14, 2021 if Georgia Gov. Brian Kemp does not veto the legislation.

S.B. 359 protects (i.e., grants immunity) health care facilities and physicians and allied health care professionals from COVID-19 negligence claims except “in cases of gross negligence, willful and wanton misconduct, reckless infliction or harm, or intentional infliction of harm.”
